The Right to Education of Migrants, Refugees and Asylum-Seekers

This report is submitted in accordance with Human Rights Council resolution 8/4. The current Special Rapporteur decided to devote his sixth and last annual report to the question of the right to education of migrants, refugees and asylum-seekers. The focus is on those who have crossed national borders, who generally are at risk of marginalization and specifically to discrimination in the provision of education.

The report aims to inform and assist Governments and interested parties in their efforts to address these matters and develop best practices so as to ensure the enjoyment of the currently unfulfilled right to education for migrants, refugees and asylum-seekers. The report addresses six core issues, the consideration of which follows an analysis of the contextual background. Attention to these issues is viewed by the Special Rapporteur as indispensable in meeting the educational challenges and opportunities related to migration. These core, but inevitably interrelated, themes are: the legal and normative framework; social and cultural issues; language and curriculum; teachers; accreditation; and learning for life.
